§ 312g Abs. 2 Nr. 3 BGB – Exclusión del derecho de desistimiento para productos de higiene


Base legal: ¿Cuándo se extingue el derecho de desistimiento?


Según § 312g Abs. 2 Nr. 3 BGB no existe derecho de desistimiento para ciertos productos:


„Contratos para el suministro de bienes sellados que no son aptos para devolución por razones de protección de la salud o higiene, si su sello ha sido retirado después de la entrega.“

Esto también se aplica cuando un sello en forma de un embalaje o envoltura especial no está explícitamente marcado como "sello de higiene", sino que ya está dado por el embalaje cerrado del producto ist.Bitte tenga en cuenta que el sello en un sentido más amplio no se limita solo a un precinto o sello específico, sino que también puede estar dado por un embalaje original intacto del fabricante.

Esta regulación sirve para proteger a los consumidores y asegura que los productos que no pueden ser revendidos por razones higiénicas o de salud no puedan ser devueltos.


¿Qué significa "sellado" en el sentido legal?


La jurisprudencia confirma que un sellado no solo debe ser una película protectora adicional, sino que también incluye un embalaje a prueba de manipulaciones que define claramente el primer uso. Lo crucial es que el producto no pueda ser revendido de manera higiénica después de ser abierto.


¿Qué embalajes cumplen con este requisito?


1. El embalaje original del producto


✔ Muchos de nuestros productos se entregan en un embalaje cerrado que define claramente el primer uso.

✔ Este embalaje no solo protege el producto en sí, sino también su estado higiénico.

✔ La apertura del embalaje se considera como la eliminación del sello y excluye el derecho de desistimiento.


2. Embalajes desechables de accesorios de higiene


✔ Mascarillas, tubos y otros artículos de higiene se entregan en embalajes individuales sellados.

✔ Estos embalajes protectores evitan la contaminación y garantizan el estado higiénico de la mercancía.

✔ Si se retira el sello o se abre el embalaje, el producto no puede ser devuelto por razones de higiene.



 

¿Por qué se excluye el derecho de desistimiento?


Muchos de nuestros productos entran en contacto directo con la piel, el aire respirado o los fluidos corporales. Después de abrir el embalaje:


🔹 No se puede garantizar más la seguridad higiénica.

🔹 No es posible una desinfección adecuada.

🔹 El producto cae bajo la exclusión legal del derecho de desistimiento.


➡ Por lo tanto, no se permite la devolución de un producto abierto.


Fundamentos legales adicionales que confirman la exclusión del derecho de desistimiento


1. Considerando 47 de la Directiva de Derechos del Consumidor de la UE (2011/83/UE)


La regulación alemana se basa en la Directiva de Derechos del Consumidor de la UE:


«El derecho de desistimiento no debería aplicarse a bienes que, por razones de higiene, no puedan ser nuevamente comercializados.»


➡ Argumento principal:

Un producto de higiene abierto o utilizado no puede ser revendido higiénicamente y, por lo tanto, está sujeto a esta regulación.


2.Jurisprudencia sobre el "sellado"


El Tribunal de Justicia de la Unión Europea (TJUE) y los tribunales alemanes han confirmado que el embalaje original se considera un embalaje protector:


📌 Sentencia del TJUE C-681/17 (Cupón FlixBus)

🔹 Un sellado no necesariamente tiene que ser una película adicional.

🔹 Lo importante es si el producto no puede ser utilizado de manera segura una vez abierto.


📌 Tribunal Regional de Hamburgo, sentencia del 13.10.2016 – 327 O 90/16

🔹 La devolución de artículos de higiene está excluida si han sido abiertos una vez.

🔹 No es posible una re-procesamiento o desinfección.


📌 Tribunal de Distrito de Dieburg, sentencia del 25.07.2019 – 20 C 484/19

🔹 Los productos que pueden entrar en contacto con fluidos corporales se consideran sellados incluso sin una película protectora adicional.


➡ Argumento principal:

Un producto de higiene que no puede ser utilizado de manera segura después de abrirse está sujeto a la exclusión legal del derecho de desistimiento.

 

 

Conclusión


✅ La revocación está excluida según el § 312g Abs. 2 Nr. 3 BGB.

✅ La directiva de la UE confirma la protección de los artículos de higiene.

✅ Las sentencias judiciales demuestran que el embalaje original también se considera un sello.

Where can you have the device adjusted if you order it online?

You can use the settings of your usual CPAP therapy on the DreamStation or Dream Station Go. The steps are clearly explained in the user manual.

Is it allowed to adjust the device yourself?

The device can be adjusted by you at any time. The individual operating steps can be found in the user manual. For further assistance, we recommend contacting your sleep lab or doctor.

What is the Flex Degree Setting?

With this, you can adjust the level of air pressure relief you feel during therapy when exhaling. This feature can be activated or deactivated by your specialist dealer. If your specialist dealer activates the "Flex" feature, they will already set a specific level for you on the device. You can increase or decrease this setting to a value between 1 and 3. The setting "1" represents a low pressure relief, while higher numbers indicate greater pressure relief.

What is the ramp function?

For a more comfortable adjustment to the inspiratory pressure of your sleep therapy, you can ask your specialist dealer to set a ramp. This means you determine a low initial pressure setting and a time period during which the device increases the pressure from the ramp start pressure to the therapy pressure setting over the specified duration.

Cpap bipap difference?

Even though CPAP and BiPAP are identical in application through the mask, functionality, and opening effect, the two ventilation methods also differ in some aspects.

The most decisive difference is the air pressure. CPAP has only one air pressure setting, whereas BiPAP has two. This means a CPAP device exerts a constant pressure on the airways, while a BiPAP mask provides higher pressure during inhalation and lower pressure during exhalation. As a result, CPAP users need to exert more effort when exhaling compared to BiPAP users.

What is positional sleep apnea?

In classic sleep apnea, the airways are repeatedly blocked during sleep, leading to interruptions in breathing. Positional sleep apnea is a special form of this condition. Here, the airways are primarily blocked when lying on the back.

Sleep apnea affects sleep quality and can significantly impact performance and overall health. If you have sleep apnea and apnea events occur twice as often when lying on your back compared to lying on your side, your sleep apnea is likely positional. Sleeping on your side can significantly reduce your symptoms.

BiPAP or CPAP?

BiPAP (biphasic positive airway pressure) is a form of ventilation that combines a ventilator with spontaneous breathing. The patient can breathe spontaneously through BiPAP ventilation without interrupting the preset ventilation rate.

This is a form of ventilation in intensive care that allows for pressure-supported breathing.

It is used when the patient needs to be ventilated but should still train their own spontaneous breathing. In obstructive lung diseases such as COPD or asthma, BiPAP ventilation can only be performed with special control, as there is a risk of under- or over-supply of breathing volume.

Why and how often should I obtain a new CPAP mask cushion?

If any part of the system shows signs of wear (cracking, splitting, discoloration, cushion damage, etc.), you should dispose of and replace the affected component.

If you wear a face mask and notice that the valve is damaged, warped, or torn, you should replace the elbow. The mask should no longer be worn if the valve is damaged, as it can no longer fulfill its safety function.
